Supreme Court Asks If Sati Can Be Banned, Why Not Multiple Wives Under Muslim Personal Law?

With Muslim women at a disadvantage under the Muslim Personal Law with no safeguard against arbitrary divorce and polygamy, the Supreme Court has now decided to examine the validity of such practices saying that it amounts to violation of women’s fundamental rights.

A bench of Justices A R Dave and A K Goel said laws dealing with marriage and succession are not part of religion and the Muslim Personal Law has to evolve with the changing times. The bench said it is high time for the judiciary to examine these issues which the court had earlier refrained from venturing into on the ground that it was a policy matter to be decided by the government and the legislature. It said these are not merely a policy matter but relate to protection of fundamental rights of Muslim women guaranteed by the Constitution. Referring to an earlier apex court verdict, the bench said practice of polygamy is injurious to public morals and can be banned just like the practice of sati was banned.

“It was pointed out that in spite of Constitutional guarantee, Muslim women are subjected to discrimination. There is no safeguard against arbitrary divorce and second marriage by her husband during currency of the first marriage, resulting in denial of dignity and security to her,” the bench said.

“In Javed vs State of Haryana, a Bench of three judges observed that practice of polygamy is injurious to public morals and can be superseded by the state just as practice of ‘sati’. It was further observed that conduct rules providing for monogamy irrespective of religion are valid and could not be struck down on the ground of violation of personal law of Muslims,” the bench said. The court passed the order while adjudicating a woman’s plea seeking share in ancestral property of her father under the Hindu Succession Act. During the hearing of the case, the lawyers pointed out the discrimination faced by Muslim women in matrimonial disputes. Taking suo motu cognisance of alleged discrimination faced by women under Muslim Personal Law, the court ordered that matter be treated as PIL and asked the Chief Justice of India to constitute an appropriate bench to look into the issue of gender discrimination under Muslim Personal Law.

“It is pointed out that the matter needs consideration by this court as the issue relates not merely to a policy matter but to fundamental rights of women under Articles 14, 15 and 21 and international conventions and covenants,” it said. The bench said that a Constitution bench earlier did not address the issue of discrimination under Personal Law but it held that Article 21 included right to live with dignity which supports the plea that a Muslim woman could invoke fundamental rights in such matters. The SC bench issued notice to attorney general and National Legal Services Authority seeking their response on the issue.

India cricketer Harbhajan Singh and Bollywood actress Geeta Basra finally tied the knot on Wednesday in Jalandhar.

The 35-year-old off-spinner and Basra completed the wedding after a long relation. The couple chose traditional attires for the ceremony.

Sachin Tendulkar was also seen at the wedding in Jalandhar with Muskesh and Nita Ambani’s son Akash.

Their wedding outfits are being styled by ace designer Archana Kochhar.



Meet The Pakistani Who Took Care Of Geeta & Yet Refused PM Modi’s Aid Of ₹1 Crore

Geeta, the Indian girl, who was stranded in Pakistan for 13 years finally came home on October 26th.  We witnessed how she captivated people in both countries at a time of heightened tensions and border clashes between the nuclear-armed rivals.

But hardly anyone knows about Abdul Sattar Edhi and his Edhi Foundation which played a big role in taking care of Geeta during her long stay in the neighbouring country.

On Tuesday, Edhi turned down PM Narendra Modi’s aid of Rs 1 crore for taking care of Geeta. That’s what humans do.

The 87-year-old founder of the Edhi foundation, Abdul Sattar Edhi, born in a small village of Bantva near Joona Garh, Gujarat, shifted to Pakistan during partition in 1947. His mother’s death due to illness became the reason behind Edhi’s decision to help the needy.

According to Edhi Foundation website, Abdul Sattar Edhi had a vision of welfare centres and hospitals that could be opened to alleviate the pain of those suffering from illness and neglect. To fulfill his dream, he established a welfare trust and named it as “Edhi Trust”.

He played his greatest role for saving the lives of thousands of newborn babies by placing the cradles outside the Edhi centres, fostering the abandoned babies and children.

Free care, feeding women and elderly citizens who were subjected to torture or neglected by their families is also among the foundation’s priority list.

Edhi got married to Bilquis, a nurse who worked at the Edhi dispensary, in 1965. The couple have four children, two daughters and two sons. Bilquis runs a free maternity home in Karachi and organises the adoption of illegitimate and abandoned babies.

Despite bitter relations between the two countries, such stories of heroic efforts restore our faith in humanity and keep our hopes alive that one day both nations will move ahead and bury the hatchet.

Varun Dhawan, Kriti Sanon, Boman Irani and a host of other co-actors too joined SRK and Kajol for the finale shoot. The climax scene is of a wedding scene and each and every actor looks stunning in their designer ensembles. With a total of 13 to 14 actors coming in one single frame for the climax, King Khan himself said,

India’s Daughter, Geeta Finally Returns Home After Living Over A Decade In Pakistan

The real life Munni is finally living her Bajrangi Bhaijaan moment. The 23-year-old Hindu girl, with hearing and speech impairment, has returned to India after living for over ten years in Pakistan. Geeta had accidentally crossed the Indo-Pak border when she was about 7 to 8 years old.

Geeta arrived at New Delhi on Monday morning with 5 members of the Edhi family via Pakistan International Airlines, to be reunited with her long lost kin in India. While in Karachi, Geeta was kept under the care of the Edhi Foundation. After living with her foster family for over a decade, Geeta was accompanied back home with Bilqees Edhi, her foster mother.

The Indian High Commission, in Islamabad, had said said Geeta will be handed over to her Indian family once the DNA test matches are confirmed. “If the DNA test of the family (who claims to be Geeta’s family) matches with Geeta’s DNA, she will be handed over to them. If the DNA test does not match, Geeta will be taken care by a good organisation till she meets her family,” confirmed PK Jain, the second secretary of the Indian High Commission in Pakistan.

Geeta was received by senior diplomats of  Pakistan High Commission at Indira Gandhi International airport. To celebrate this extraordinary homecoming, Geeta and the Edhi family will be given a warm welcome by Pakistan High Commissioner Abdul Basit on Monday evening.

Fahad Edhi of the Edhi Foundation said that the Indian authorities had assured them that in case the DNA tests came back negative, Geeta would be placed in safe custody. “She has been with us for so many years, she is like a family member and we would like her to stay with us. But obviously she wants to be in her country and with her real family,” said Fahad.

Geeta had identified her father, siblings, and step-mother in a photograph that was sent to her by the Indian High Commission. Janardhan Mahto is in Delhi to receive her first born daughter who he lost in a fair in 2004 and who he fondly remembers as calling Heera.

The team of Dilwale – including Rohit Shetty, Kajol, Shah Rukh Khan, Varun Dhawan and Kriti Sanon – hosted a special press junket in Hyderabad over the weekend, where they are currently wrapping up the shooting of the film. They invited the media to have a look at their sets, interact with the star cast and – incredibly – watch quite a bit of footage from the film. And while the footage was still rough cuts, we liked what we saw. So if you’re looking forward to Dilwale this December, here’s a few things YOU can expect from this biggie.

1. Some good old-school Shah Rukh Khan and Kajol romance

This was what I was most excited about when Dilwale was announced, and it seems like we won’t be disappointed. We were shown one of the songs from the film that is picturized in Iceland, and it’s pretty much an homage to their romance. In fact, you’ll even think that it reminds you of another iconic SRK and Kajol song.

2. It’s typical Rohit Shetty Rohit Shetty

Is in his element with this film, so if you’re a fan of his cinema, you shouldn’t be disappointed with Dilwale. There are some high-octane action sequences, amazing car chases and, of course, the blowing up of vehicles.

3. Everything has been taken a notch higher

Having said that, while Dilwale is a typical Rohit Shetty film, it seems to be taken a notch higher. The vfx is amazing, and – this time around – Rohit Shetty is blowing up BMWs instead of Scorpios.

4. Varun Dhawan and Kriti Sanon’s chemistry is surprisingly good

Yes, there’s a height difference between the two (Kriti is TALL!), but we like that it’s almost celebrated rather than hidden. They look great together, too, and a track featuring both of them is probably going to be one of your favourites on the soundtrack.

5. Varun Sharma is back!

You loved him as Choocha in Fukrey, and he’s back with Dilwale. His scenes with Varun Dhawan are a lot of fun, and I’m going to venture a guess and say that you’re going to love their bromance.


Yeah, that deserved caps lock. There’s no one quite like him, and while we didn’t see too much footage featuring him, we hear his scenes were absolutely hilarious. In fact, Kajol said that they kept cracking up while shooting for this film because of Johnny Lever’s comic timing. And the fact that Sanjay Mishra is also in this film is just icing on the cake.

7. There are some stunning locations

The aforementioned SRK-Kajol song set in Iceland is particularly gorgeous, but in general, the film features some beautiful looking locations. It’s going to be a treat for the eyes, that’s for sure.
